Warranty

  1. Products covered by this limited warranty
    • Pillows manufactured by MIZU FOOD TECH PRIVATE LIMITED. (“Cuddl”) and sold by Cuddl.
    • Accessories (Deodorizer inserts, aroma therapy inserts, protectors, outer shells and spare fill) are not covered under the warranty.
  2. Who this warranty extends to
    • This limited warranty extends only to the original purchaser of any Cuddl Pillow.
    • Warranty is applicable only for the period of ownership by the original purchaser.
    • Please retain a copy of the original receipt as a proof of this purchase.
    • The warranty is not transferable.

  5. What this limited warranty covers
    This limited warranty applies to the following defects:
    • Loss of loft (bounce & fluffiness) of the Core fill material – Shredded Latex Foam.
    • Cuddl Standard Bed Pillow: loss of loft of greater than 10%, i.e 0.5 inches when filled with 2 Kg of core fill.
  6. Exclusions
    • Defects to the outer shell, inner cover & zipper assembly.
    • Any defects caused due to improper use of pillow or use without proper support.
    • Physical abuse or damage to the fill and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
    • Exposure to direct sun light.
    • Purchased from unauthorized sources.
  7. Cuddl’s responsibilities
    • In the event of a genuine defect, Cuddl’s sole and exclusive liability will be to provide a repaired or a replacement pillow or pillow cover, at its own discretion.
    • Address the warranty claim within 90 days of receiving an eligible warranty claim.
    • Undertake the to-and-fro shipping and transportation costs that are a part of the warranty claim for a period of upto 1 year from the original date of purchase.
  8. Purchaser’s responsibilities
    • Purchaser should return the defective product to Cuddl to initiate the claim process.
    • Original proof of purchase should be attached.
    • Product should be shipped to the address mentioned at the bottom of this page.
    • Undertake to-and-fro shipping and transportation costs that are part of the warranty claim beyond a period of 1 year upto the end of warranty period from the original date of purchase.

  10. Disclaimer, limitation on liability
    To the extent permissible by applicable law, the pillow is provided “as is” and this warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. In no event will Cuddl or its suppliers be liable for of procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the mattress or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if Cuddl has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. Sunday’s total liability will not exceed the purchase price paid for the pillow giving rise to such liability.
  11. Arbitration and governing law
    Applicable law will be exclusively such prevailing laws in the state of Karnataka and the venue of arbitration will be exclusively limited to the City courts of Bangalore.
